Ministry of Environment Order Ignored

An order issued by the Ministry of the Environment in February 2011 has been ignored by a business in St.Catharines, Ontario. A smash repair operator, Sam Demita who owns Sun Collision on Merritt Street had been ordered by MOE investigators to move damaged vehicles from his property line that abuts a public park and a neighbourhood. This order was issued so as to prevent the leaching of dangerous chemicals into the environment and a stormwater drainage system. The Environmental Commissioner of Ontario made a statement in his Annual Report Supplement 2010/2011, supporting the concern of leaching break fluid, antifreeze, and motor oil which may pollute water sources with ethylene glycol, heavy metals and petroleum distillates.

Photographs taken through intervals of several months apart during 2011 and into January 2012 show damaged vehicles remain at the property line. Sam Demita of Sun Collision has no desire to move the damaged vehicles, obey the instructions of the MOE, (who obviously have not monitored the property even though Sam Demita of Sun Collision had been found in an earlier investigation by MOE to have intentionally breached the EPA and Ontario Regulation #347 by burying illegal waste material such as hundreds of tonnes of asphalt) or care for the stormwater drainage system or a public park and neighbourhood. The City of St.Catharines has serious questions to answer in this situation revolving around the property where Sun Collision has been established. The MOE stated in their report dated February 16 2011 that all damaged vehicles were to be moved from the property line. Sam Demita owner of Sun Collision did not move the vehicles through the whole of 2011 and photographs now in January of 2012 still show damaged vehicles at the property line. Sam Demita's arrogance at ignoring the MOE order is clear, any potentially dangerous chemicals have had at least a year to slowly leach into the soil. Where is the MOE monitoring?
